ESA Help with the Contributory Based and Income Based Options

Hi all,

Does anybody know about the difference of the above and how they will affect me.

I lost my job in August last year due to my illness.

I claimed ESA and had help with the ESA 50 form and I have been placed in the Support Group.

I was told that I am in the ESA for Contributory Based not Income Related and that this is what I should be in.

I was sent a form last week, which i completed and sent my P45 to the job centre, with all the reforms and everything how would this affect me????

Any help of information would be much appreciated.

Hi Michelle...
as it Welfare Reform Bill stands at the moment , if you are in the support group and receiving Contributions based ESA , that payment will not be affected by family income / savings / second home etc

See other post here.
If you are not in the support group , then as the Bill stands at the moment you will only be able to claim ESA (contribution based ) for a year.

If you are in the support group , you should seriously consider whether you qualify for DLA , and other help .

There are huge changes in the next couple of years so keep an eye out :)

thanks for your reply Rich,

I am in the Support Group and have been told that I should be getting Income Related ESA, but I have been on Contributions based ESA.

Its all very confusing

I filled in the form anyway so i will just wait and see what they come back with

Ahhh i misunderstood you ,
Entitlement to Contributions based ESA is dependant on National Insurance Contributions prior to claiming Benefit .
The basics are here.

You will definitely need to see an Advice Centre since it sounds like they could looking at the possibility that an error has been made in working out your entitlement to contributory ESA.

The amounts are the same , except that with Income Related ESA .. any partner's income and savings etc will be taken into consideration as well as savings . Even if this doesn't affect you now it could do in the future , if for example you get an inheritance , or a partner earns more money.

If you already have a partner , second property , savings etc then this could have created an overpayment .Recovery of that could depend on whether it was their error or a failure to disclose info on your part.

If you have had been on ESA, had work for a while and then gone back onto ESA it is also possible that you could fall under something called Linking Rules . This is where you can go back on the same ESA that you were on if your period of work lasts either 13 weeks or 52 weeks depending on circumstances.

It is too complicated to explain on the forum , but if you get an adverse decision then read all mail from them fully and seek face to face advice .

Thanks for that info, I think it must be that I claimed ESA before I went back to work, and then I claimed again when i was dismissed, as nothing else has changed.

I will wait for the letter to come back regards the form that i have sent back to them, and let you know.
